Terms of Service
Table of Contents
1. Acceptance of Terms
By accessing or using the website at https://webcrest-agency-production.up.railway.app, submitting a project request, or contracting WebCrest for web design, engineering, or consulting services, you agree to be bound by these Terms of Service.
If you do not agree to these terms, please do not access our site or commission our development services.
2. Services & Project Scope
WebCrest provides custom web design, frontend and full-stack software development, UI/UX prototyping, performance optimization, and digital strategy services.
Each project scope—including deliverables, timelines, estimated budgets, and milestone expectations—is defined based on client submissions through our project request form or mutually agreed written proposals. Any material additions or adjustments outside the agreed scope may be subject to a revised estimate.
3. Intellectual Property & Ownership
Your Deliverables: Upon receipt of full and final payment for a commissioned project, the client receives 100% full ownership of all custom design assets, bespoke code, and content specifically produced for their project.
Open-Source Technologies: Pre-existing open-source libraries, frameworks (e.g. Next.js, React, Tailwind CSS), and third-party tools remain governed by their respective licenses (such as MIT or Apache 2.0).
Portfolio Rights: Unless explicitly agreed otherwise under a written Non-Disclosure Agreement (NDA), WebCrest reserves the right to showcase the completed website or design in our public portfolio and case studies.
4. Estimates, Payments & Milestones
We pride ourselves on transparent, honest, and straightforward pricing:
- Milestone Structure: Projects typically follow a structured milestone schedule (e.g. a starting deposit to initiate design/architecture, followed by the remaining balance upon final approval prior to domain launch).
- No Hidden Costs: Any third-party costs (such as domain registration, premium third-party APIs, or specialized database plans) are clearly communicated in advance.
- Invoices & Receipts: Digital invoices are issued for all completed milestones and service payments.
5. Review Cycles & Revision Policy
Client satisfaction is paramount. During the development process, you will receive private live staging preview links to interactively test your website across mobile, tablet, and desktop screens.
Each project package includes dedicated revision rounds to refine styling, typography, spacing, copy placement, and animations. Revisions that fundamentally alter previously approved specifications or architecture will be quoted separately before work begins.
6. Hosting, Deployments & Third Parties
We assist with seamless deployment to modern hosting platforms (such as Vercel, AWS, or Cloudflare) and configuration of custom domains with SSL certificates.
While we optimize all code for 99+ performance and uptime, WebCrest is not liable for service outages, rate limits, or disruptions caused by third-party hosting providers, domain registrars, or external APIs beyond our direct control.
7. Limitation of Liability
To the maximum extent permitted by applicable law, WebCrest will not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, or business goodwill—arising out of or related to your use of our services or completed websites.
WebCrest’s total cumulative liability for any claim arising out of these terms shall not exceed the total fees paid by you to WebCrest for the specific project in question.
